The legal recognition of gender identity has come as a fact by the L. 4491/2017, which in fact has created more problems than solutions, especially regarding the matters of maternity and paternity in the context of the Greek Civil Code. Furthermore, there is no reference to the “non binary” gender in comparison with the German jurisprudence. Concerning to the context of the L. 4491/2017, it is acknowledged that a big step forward has been made towards the future for the reformation of human rights, according to the principles of liberty, equality and fraternity, indeed not only by the Greek jurisprudence and laws, but also by the decisions of Echr and the Council of Europe.
