The purpose of this study is to present and discuss various issues with regard to the possibility to serve a sentence at home, and to address substantive and procedural dogmatic issues in terms of interpretation. A sentence, as a flexible measure, requires individual adjustment, following in concreto assessment; such flexibility is not shown only at a regulatory level but also during the measurement or the serving of a sentence. ‘Sentence flexibility’ has traditionally meant the possibility to alter the time limits of the remaining custodial sentence. Following recent amendments to the relevant regulatory framework, new methods of the sentence flexibility have been introduced, such as the possibility to serve a sentence at home as well as the conditional release and placement under house arrest and electronic surveillance.
