How the common law perception and the jurisprudence of ECtHR affect the Greek criminal procedure
Since Al- Khawaja and Tahery set an example of “dialogue” between the British courts and the ECtHR, the issue of interaction of ECtHR and national legal orders has gained front page attention. This book is about the impact of ECtHR jurisprudence concerning the confrontation right in the Greek criminal procedure. In order to fully understand the notion of confrontation right adopted by ECtHR the perception of the right in common law countries, especially in UK is indispensable. An extensive analysis of confrontation right in Criminal Justice Act 2003 has been conducted together with the presentation of the law of evidence. The insight in the British legal system has been fruitful for elaborating de lege ferenda recommendations for the Greek criminal procedure.
