H μελέτη “The new EU Directive (2014/49/EU) on deposit guarantee schemes: an element of the European Banking Union” αποσκοπεί σε μια συστηματική παρουσίαση και συνεκτική ανάλυση των διατάξεων της νέας Οδηγίας (2014/49/ΕΕ) του Ευρωπαϊκού Κοινοβουλίου και του Συμβουλίου, της 16ης Απριλίου 2014, «περί των συστημάτων εγγύησης των καταθέσεων». Η Οδηγία αποτελεί τμήμα του νέου Ευρωπαϊκού Τραπεζικού Δικαίου, όπως αυτό έχει σταδιακά διαμορφωθεί από το 2008, προκειμένου να αντιμετωπιστούν αποτελεσματικά: i) οι ρυθμιστικές αστοχίες που εντοπίστηκαν κατά τη διάρκεια της πρόσφατης (2007-2009) διεθνούς χρηματοπιστωτικής κρίσης, ii) η ανάγκη για περαιτέρω «εξευρωπαϊσμό» του «διχτυού ασφαλείας του τραπεζικού συστήματος», απόρροια της τρέχουσας (και ολοένα εντεινόμενης) δημοσιονομικής κρίσης και κρίσης χρέους στην ευρωζώνη, με απώτερο στόχο την εγκαθίδρυση μιας Ευρωπαϊκής Τραπεζικής Ένωσης. Η μονογραφία “The new EU Directive (2014/49/EU) on deposit guarantee schemes: an element of the European Banking Union” είναι δομημένη σε πέντε ενότητες: i) η Ενότητα Α οριοθετεί τη θέση της Οδηγίας εντός του νομικού πλαισίου της Ευρωπαϊκής Τραπεζικής Ένωσης και, εν γένει, των νομικών πράξεων που αποτελούν τις πηγές του Ευρωπαϊκού Τραπεζικού Δικαίου, ii) η Ενότητα Β αναλύει τις γενικές πτυχές της Οδηγίας, συμπεριλαμβανομένου του αντικειμένου της, του πεδίου εφαρμογής της, καθώς και των κανόνων που αφορούν τη σύσταση, την επίσημη αναγνώριση και την εσωτερική λειτουργία των εθνικών συστημάτων εγγύησης των καταθέσεων, iii) η Ενότητα Γ επικεντρώνεται στην ανάλυση των διατάξεων της Οδηγίας αναφορικά με τη θέση των πιστωτικών ιδρυμάτων ως μελών των συστημάτων εγγύησης καταθέσεων, iv) η Ενότητα Δ εξετάζει τις ρυθμίσεις που άπτονται της χρηματοδότησης των εν λόγω συστημάτων, και v) η Ενότητα Ε αναλύει τους κανόνες σχετικά με την αποπληρωμή των καλυπτόμενων καταθέσεων. Τέλος, οι καταληκτικές παρατηρήσεις αποτυπώνουν τα στοιχεία συνέχειας και αλλαγής που επήλθαν σε σχέση με την Οδηγία 94/19/ΕΚ αναφορικά με την ίδια θεματική και περιλαμβάνουν μια συνολική αξιολόγηση των νέων διατάξεων.
